Section 7 Consultation

As part of the Warrior Project Relicensing, potential effects on federally listed species and habitats must be examined. Alabama Power has worked with stakeholders throughout the process to identify potentially affected species and habitats. In hydro relicensing, applicable laws, including Section 7 of the Endangered Species Act, require FERC to consult with the U.S. Fish and Wildlife Service (USFWS) to resolve these potential effects. Federal regulations allow FERC to designate a non-federal representative to consult directly with the USFWS. On August 18, 2003, Alabama Power received this designation and has conducted an informal consultation process with the USFWS. The final product of this consultation will be a Biological Assessment that will be included in the Final Environmental Assessment as part of Alabama Power's application for a new license for the Warrior Project.
